Conditions Governing the Reproduction of Works of Art

  1. Objects in the Mount Holyoke College Art Museum's collections shall not BE reproduced in any way without prior written consent of the Museum.
  2. Only images supplied or approved by the Museum shall be used for the reproduction of its collections.
  3. Fees are payable upon receipt of invoice unless the Museum specifically agrees otherwise in writing, and are not refundable if the work is subsequently not used.
  4. This permission is a non-exclusive, single-use license to reproduce the work(s) in one edition in the one language specified, unless otherwise agreed by the Museum in writing. Permission to use the reproduction(s) in reprints, revised editions, foreign language translations, or derivative works must be requested separately.
  5. This permission is valid only for the individual, company, or institution to whom it is specifically issued and may not be transferred, assigned, sold, or otherwise disposed of without the Museum's permission in writing. In case of joint publishing ventures, both parties must obtain permission and agree to the conditions; if this is not done, the permission is valid only for the party which has completed this requirement, who thereby undertakes to withhold the reproduction of the Museum's work from the other party. The party receiving this permission undertakes not to make the photographic material, color separations, plates, or any other related material available to any other person, company, or institution without the Museum's permission in writing.
  6. Permission to reproduce a work is subject to any reproduction rights the artist may have retained. The Museum assumes no responsibility for any royalties or fee claims by the artist or on the artist's behalf or any claims by any outside party.
  7. Only publications bearing appropriate copyright notices may reproduce works in the Museum's collections. A reproduction of a work constitutes a warranty to the Museum that all available copyright protection for the reproduction has been secured. Such copyrights, insofar as they apply to the reproduction(s) of the Museum's work(s), may not be transferred or assigned without the Museum's permission in writing.
  8. The Museum reserves all television and motion picture rights on all reproductions of works in the Museum collections.
  9. The work must be reproduced in its entirety unless express permission is given to crop or to print details, which must be appropriately identified. Nothing may be superimposed on the image.
  10. Permission to reproduce a work in color is contingent upon the Museum's approval of one or more proofs, as necessary, which must be submitted in time to make corrections before the final printing. If a proof satisfactory to the Museum is not attained, permission to use the color reproduction is automatically withdrawn.
  11. All reproductions shall be identified as on the label provided by the Museum, and shall bear the following credit line unless written permission is obtained from the Museum:
    - Mount Holyoke College Art Museum
    - South Hadley, Massachusetts
    - Please do not abbreviate the name of the museum in any way.
  12. The Museum must be sent 1 copy of any publication (films excluded) in which reproduction(s) of works of art in its collection appear. If this is not possible in the case of very costly books, tear sheets and full bibliographic information must be supplied when the publication appears.
  13. This permission is valid for a period of two years. If the publication has not appeared at the end of that time, permission is automatically revoked and must be requested again.
